Client agreement
This agreement covers every website Chestnut Lane Websites builds and publishes for a client. You accept it by paying the payment link we send once your site is live.
1. Who this is between
This agreement is between Jacob Arbittier, a sole proprietor doing business as Chestnut Lane Websites ("we"), and the business that pays for its website ("you"). Your business name, contact email and website address are the ones on the invoice.
2. What we build
We build you a one-page website in the look you choose from the sample we sent.
- Content: your business details come from your existing public listings and anything you send us. We do not add prices, reviews, awards or claims you have not given us.
- Photos: stock photos are used as general atmosphere only, never presented as your shop or your work. You can send your own photos to replace them at no charge before launch.
- Works on phones and computers, with tap-to-call, directions and a contact form that opens an email to you.
- Launch: we publish the site on your web address once you have pointed it to us (section 5), or on a free Chestnut Lane address until you do.
3. Price and payment
The website costs $350, one time, and you pay only after it is live.
- When the site is live, we email you a secure payment link. Payment is due within 14 days.
- Paying the link is your acceptance of this agreement.
- There is no monthly fee and no subscription.
- If you have not paid within 30 days of launch, we may take the site offline. Nothing else is owed if you decide not to keep it.
4. Updates
After launch, each round of updates costs $75.
- A round is one email listing the changes you want, such as new hours, a closure notice, a price list, new photos, or edits to services and wording.
- We make the changes within 5 business days of receiving your request and payment.
- Not included in a round: new pages, a new design or look, online booking or store features, or writing large amounts of new copy. We quote those separately if you ask.
5. Domain and hosting
You keep owning and paying for your web address (domain). We never need your passwords.
- Pointing your domain: we send you step-by-step instructions for your domain provider (also at chestnut-lane.com/domain). Making that change is your responsibility. Until it is done, your site stays on a free Chestnut Lane address.
- Hosting: we host the site at no charge as a courtesy. We aim to keep it online but do not guarantee uninterrupted service.
- If we stop hosting: we give you at least 30 days' notice by email and send you the complete site files so you can host them anywhere.
- Moving away: you can ask for your site files at any time and host them elsewhere.
6. Ownership and licenses
Once you have paid, the website is yours to use for your business.
- Your content: your name, logo, text and photos remain yours.
- Stock photos are licensed under the Unsplash License, which allows commercial use. You may keep using them on your site.
- Fonts are open-source and free for commercial use.
- Our design and code: we keep the right to reuse our general design templates for other clients, but never your content.
- Portfolio: we may show your finished site as an example of our work. Email us if you would rather we didn't.
7. Your responsibilities
- Check the site before you pay and tell us if anything is wrong.
- Keep us told when your hours, address or other details change. Those changes are an update round (section 4).
- Only send us materials (photos, logos, text) you have the right to use.
- You are responsible for the accuracy of the details you give us and for following any rules that apply to your own business.
8. Fixes and refunds
- Our mistakes are free to fix for 30 days after launch: wrong details we entered, broken links or buttons, or display problems on common phones and browsers.
- Refunds: because you see the finished site before paying, payments are not refunded. If we cannot fix a problem that is our fault within 30 days, we refund the $350 in full.
- Update rounds (section 4) are not refunded once the changes are made.
9. Limits on liability
- Apart from what this agreement promises, the website is provided "as is." We do not promise any number of visitors, calls, customers or search rankings.
- We are not responsible for losses caused by your domain provider, your email provider, outages outside our control, or changes you or others make to the site.
- Our total liability under this agreement is limited to the amount you paid us in the 12 months before the claim.
- Neither of us is liable to the other for indirect or lost-profit damages.
10. Ending the agreement
- You can end this agreement at any time by email. We send you your site files and stop hosting within 30 days.
- We can end it with 30 days' email notice, and we send you your site files.
- Sections 6, 8 and 9 continue to apply after the agreement ends.
11. General terms
- This agreement is governed by the laws of the State of California.
- It is the whole agreement between us about your website and replaces any earlier messages about it.
- We may update these terms for future work. Changes never apply to work you have already paid for.
- All notices are by email: ours come from hello@chestnut-lane.com, and yours go to the same address.
